Meta potentially breaching Italian law through AI use in WhatsApp
The Italian Competition Authority (AGCM) has launched an investigation into Meta, the parent company of Facebook and WhatsApp, over concerns that the integration of Meta's AI service into WhatsApp could be a violation of Article 102 of the Treaty on the Functioning of the European Union (TFEU).
The AGCM believes that Meta's actions could potentially abuse its dominant position in the consumer communications app market, harming competition from other AI providers. This stems from Meta's placement of its AI service in a prominent position on the WhatsApp screen and integration into the search bar, which users may not have explicitly requested.
Meta, however, maintains that its approach is compliant with the law. The tech giant is cooperating with the AGCM's investigation and has not directly disputed the possibility that integrating its AI into WhatsApp could confer market dominance.
A Meta spokesperson stated that offering free access to AI features in WhatsApp gives users the choice to use AI in a place they already know, trust, and understand. However, the imposition of Meta's AI on WhatsApp could potentially lock users into Meta's AI ecosystem, further entrenching Meta's market dominance and limiting competition from local AI firms.
The AGCM's investigation is ongoing, with the European Commission's competition departments working closely to ensure fair competition in the digital market. If found guilty of violating Article 102 TFEU, Meta could face fines up to 10% of its global annual revenue, a substantial financial penalty designed to deter anti-competitive practices in the EU internal market.
As the investigation progresses, the outcomes could include heavy fines and enforceable remedies to restore competition under EU competition law. It is important to note that at this stage, no final judgment has been made.

The AGCM's investigation raises questions about the regulation of AI technology within the consumer communications app market, particularly in relation to Meta's integration of its AI service into WhatsApp. If Meta's actions are found to violate Article 102 TFEU, it could potentially face significant fines and be required to implement enforceable remedies to promote competition in the market. This could impact the software landscape, potentially allowing for increased competition from local AI providers.
