Meta, the corporate entity behind Facebook and Instagram, has gained court approval to scale up AI system training with user data from Germany. The American tech giant aims to analyze all previous posts made on these platforms to enhance its AI models. Users, however, have a narrow window to opt out, as the deadline for this option expired early on Tuesday.

WhatsApp, another Meta-owned platform, does not fall under this initiative, as its chats are encrypted. Conversely, conversations with the AI assistant "Meta AI" are deemed public and can be utilized for training purposes.

Court Green Light

In a preliminary hearing, German consumer protection organizations sought to prohibit the utilization of data for AI training. The Higher Regional Court of Cologne, however, dismissed the claim, deeming Meta's AI software Meta AI eligible for use with user posts on Facebook and Instagram (Az. 15 UKl 2/25). The consumer center of North Rhine-Westphalia spearheaded the lawsuit, citing potential violations of European data protection law as grounds for an interim injunction.

Following the court ruling, a Meta spokesperson declared that the AI training process adheres to all data protection regulations. They reiterated the commitment to providing German AI technology to the European population and ensuring equal access to the benefits of generative AI.

Gap in the AI Race

Thus far, Meta lags behind the AI market leaders. A recent survey by the German digital industry association Bitkom revealed that OpenAI, Microsoft, and Google remain significantly ahead in terms of AI application usage by the German population. Meta's AI language model Llama did not appear in the list of the most frequently used AI applications.

Meta introduced Llama as an open-source system in 2023, stirring debate within the expert community. Many experts now believe that Meta might struggle to match the pace of the three US market leaders, with Chinese competitors like DeepSeek showing greater dynamism.

The Hamburg Data Protection Commissioner (HmbBfDI) has initiated proceedings to potentially halt Meta's AI training activities in Germany for a minimum of three months. These complications further emphasize the unique challenges Meta faces in the European AI landscape.
