The North Rhine-Westphalia (NRW) tax authority has launched a new website dedicated to providing influencers and content creators with practical guidance on all tax-relevant topics. This resource aims to address the growing economic importance and professionalization of social media influencers, and to clarify their tax responsibilities under German law as applied in NRW.

The website, which can be found at tax-influencers.nrw.de, bundles all tax information in one central place, making it easy to understand and always accessible. It covers topics such as income tax, trade tax, VAT, sponsorships, product placements, merchandise sales, and prize money.

NRW Finance Minister Marcus Optendrenk (CDU) stated that the goal of the website is to support the influencer industry, create legal certainty, and accompany a successful career path. He emphasized that the website does not assume that most of those affected have acted deliberately or mention the fact that more than half of the influencers under investigation do not have a German tax number.

Key topics covered by the guidance include criteria to determine whether influencer activities constitute self-employment or a hobby, tax obligations related to income generated from promoting products and services, social security conditions and implications arising from influencer commercial activities, and instructions aimed at helping influencers comply with tax reporting and avoid accusations of tax evasion.

The new website is part of the NRW tax authority's view of influencers as a growing and important industry. Tax investigators in NRW are currently examining around 6,000 datasets related to influencers, suggesting a potential tax loss of around 300 million euros.
